2. The petitioner apprehends his arrest in connection with Akilpur P.S. Case No. 60 of 2023 dated 16.08.2023 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code (in short 'IPC') and later on Section 302 IPC is also added.
3. Learned counsel appearing for the petitioner submits that there is no specific allegation against this petitioner in the FIR and the main allegation of having assaulted the victims is against the coaccused, Gajendra Singh, and no any specific role of the petitioner has been revealed in the FIR in commission of the alleged offence. Learned counsel further submits that the petitioner has fair and clean antecedent and one namely, Bhola Singh who is said to be the victim was seventy year old and he intervened in the alleged occurrence to pacify the matter but he fell down and became injured and during the
Patna High Court CR. MISC. No.67657 of 2024(2) dt.20-09-2024 2/2 course of treatment, he died and two co-accused, namely, Rinku Devi and Puja Devi @ Manisha Devi, carrying almost similar nature of allegation have been granted the relief of anticipatory bail by this Court vide order dated 20.08.2024 passed in Cr. Misc. No. 47964 of 2024.
4. Learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the above submissions and mainly taking into account the petitioner's fair and clean antecedent and the nature of allegation appearing against him from the FIR, this Court is inclined to accept his anticipatory bail prayer. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Akilpur P.S. Case No. 60 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
