Petitioner is apprehending his arrest in connection with Majhaulia P.S.Case No.375 of 2018 , registered for offences punishable under Sections 341,3 23, 385,387, 379, 504 and 506/34 of the Indian Penal Code.
As per the FIR, the petitioner and other accused persons tried to harvest the cane crops of the informant and on protest they demanded rangdari of Rs.05 lac. It further appears that the petitioner is accused in one more case of similar type. Submission of the learned counsel for the petitioner is that the lands belongs to the petitioner and mutation is in the name of the father of the petitioner, rent is being paid by the petitioner also, which will appear from Annexure-2 and in order
Patna High Court CR. MISC. No.62713 of 2019(2) dt.15-10-2019 2/2 to grab the land, the present case has been lodged. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Majhaulia P.S.Case No.375/2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
