JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2023 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no. 1 since during the pedency of this application, he has been arrested. Permission is accorded.

Accordingly, the application of petitioner no.1 Rishideo Yadav is dismissed as withdrawn.

Heard learned counsel for the petitioner nos. 2 and 3 and the learned A.P.P. for the State as well as learned counsel for the Informant.

The petitioners apprehend arrest in connection with Uda Kishunganj P.S. Case No. 207 of 2022 registered under

Patna High Court CR. MISC. No.63827 of 2022(2) dt.10-01-2023 2/2 Sections 420, 406, 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Both the parties have compromised the present case.

Further he submits that petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner nos. 2 and 3 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.-I, Uda Kishunganj, Madhepura in connection with Uda Kishunganj P.S. Case No. 207 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
