JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 342, 323, 325, 307 and 447/34 of the Indian Penal Code.
Allegation is petitioner no. 1 established physical relationship with informant on assurance to marry her but he married another girl. On protest, all the petitioners assaulted on her abdomen and as a result she suspected miscarriage of her three months old pregnancy.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. Informant is the Bhabhi of petitioner no. 1. There is no medical report to suggest that informant had gone for abortion. From perusal of Annexure-2 it is evident that there is no external injury on the body of the informant. Petitioners have falsely been implicated in the present case. On behalf of the State, it is submitted that petitioners are

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case no. 753 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
