2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201, 120(B)/34 of the Indian Penal Code and Section 27 of Arms Act.

3. The prosecution story, in brief, is that the accused persons including the petitioner has killed the husband of the informant under conspiracy.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity. There is no overt-act or any specific role attributed against the petitioner. No any direct or consistent material has come against

Only on the basis of suspicion, the petitioner's name was sprang up in the case. It is further submitted that the petitioner is languishing in judicial custody since 18.5.2023. Moreover, similarly situated coaccused persons have already been granted bail by different coordinate Bench of this Court and in support of this Annexure-2 has been annexed with this petition.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Saraiya P.S. Case No. 124 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Muzaffarpur.
