JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given iron rod blow causing head injury to informant which was found grievous in nature. Petitioner appears to be in jail custody since 13.12.2015 in a case in which charge sheet has been submitted under Section 307 and other minor sections of the Indian Penal Code. Contention on behalf of the petitioner is that petitioner and informant are next door neighbours and even if the prosecution case assumed to be true, then also, the alleged occurrence took place on account of petty quarrel.
