JUSTICE ARUN KUMAR ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Nawada Mahila P.S. Case No.57 of 2016 registered under Sections 498A, 504 and 363/34 of the Indian Penal Code.
Allegation in brief is that the petitioner on the promise of marriage established physical relationship with the informant, later on, married in the mosque but now ousted from the matrimonial home.
Submission is that the girl is major and it was a consensual sexual relationship. Moreover, he has been in custody in this case since 18.1.2017.
Having considered the said facts and circumstances, the petitioner, namely, Md. Raunak is directed to be released on
Patna High Court Cr.Misc. No.26193 of 2017 (4) dt.20-07-2017 2/2 bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, IIIrd, Nawada in connection with Nawada Mahila P.S. Case No.57 of 2016 with a condition that he shall remain physically present during the course of trial on each and every date. On failure to appear on two consecutive dates without any reasonable cause, his bail bonds shall be cancelled. (Arun Kumar, J) N.H./- U T
