2. Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.Ps. for the State.
3. Petitioners seek regular bail in connection with Kako P. S. Case No. 334 of 2024 in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.
4. As per F.I.R., on 19.11.2024, father of the informant went to Dalan to sleep and on 20.11.2024, in the morning, his dead body was found hanging in the courtyard with rope by granddaughter of the deceased.

Learned counsel for the petitioners submits that from perusal of the F.I.R. it is apparent that informant is not an eye witness of the alleged occurrence and only suspicion has been raised against these petitioners. From perusal of the F.I.R., it is also apparent that it was petitioner Pawan Yadav who helped bringing the dead body down which was hanging in the courtyard. During course of investigation, none of the witnesses have claimed to have seen these petitioners committing the offence nor any of the petitioners were last seen with the deceased. It is further submitted that similarly situated coaccused, namely, Krishna Kumar has already been granted anticipatory bail by co-ordinate Bench of this Court vide order
Patna High Court CR. MISC. No.66411 of 2025(4) dt.11-11-2025 3/3 dated 08.05.2025 passed in Cr. Misc. No. 14784 of 2025. Petitioners are in custody since 05.05.2025.
6. Learned counsel for the State as well as learned counsel for the informant vehemently opposed the bail application.
7. Considering the nature of allegation, materials available on record and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Jahanabad in connection with Kako P. S. Case No. 334 of 2024.
