Petitioner seeks regular bail in Rohtas P.S. Case No.6/17 registered for the alleged offences under Sections 304 and 201/34 of the Indian Penal Code.
As per the prosecution case, the father of the informant is said to have died due to electrocution by coming in contact with the naked electric wire laid by the petitioner and his son, namely, Vicky Kumar in his field and the dead body was found in the sugarcane field of Shivashray Singh. It has been submitted by learned counsel for the petitioner that the petitioner is an innocent person and has committed no offence. There is no eye witness of the alleged occurrence. The dead body of the deceased was not found in the field of the petitioner rather it was found in the sugarcane field of
Patna High Court Cr.Misc. No.26521 of 2017 (02) dt.13-06-2017 - 2 - Shivashray Singh. The co-accused Vicky Kumar has already been enlarged on bail by a co-ordinate Bench of this Court in Cr. Misc. No.23843 of 2017 vide order dated 24.05.2017. The petitioner is languishing in jail since 15.04.2017.
Considering the facts aforesaid and the nature of allegation as made against the petitioner, the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dehri, Rohtas at Sasaram in Rohtas P.S. Case No.6/2017.
