JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Originally, the informant filed complaint case which was converted into Gardanibagh P.S.Case No. 507 of 2003 and, accordingly, formal F.I.R was drawn for the offences punishable under Sections 364/34 of the Indian Penal Code. The accusation against the petitioner and two others is that they had given threatening of dire consequence to the informant's son and on the basis of the aforesaid threatening, the informant doubted that his son was kidnapped by petitioner and his associates when the informant's son went missing. Learned counsel for the petitioner submits that that no doubt, the present case was lodged in the year 2003 but the investigation was completed in the year 2007 and neither any

Patna High Court Cr.Misc. No.13200 of 2016 (2) dt.01-04-2016 2/2 notice nor any process was ever served upon the petitioner and all of sudden, petitioner was arrested by the police on 13.11.2015 and since then he is in jail custody. Petitioner does not have any criminal antecedent.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Gardanibagh P.S.Case No. 507 of 2003.
