JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-06-2016 Heard Sri Uday Chand Prasad, the learned counsel for the petitioner and the learned Additional Public Prosecutor. The petitioner apprehends his arrest in a case under Section 328, 302 of the Indian Penal Code.
The case is of the year 2011. It is submitted that charge sheet has been submitted under section 306 of the IPC and there is nothing on record to show that petitioner administered poison to the deceased but it appears that petitioner has been declared absconder and charge sheet has already been submitted. After some argument, the learned counsel for the petitioner seeks permission to withdraw this anticipatory bail petition.
The prayer is allowed.
Patna High Court Cr.Misc. No.11514 of 2016 (4) dt.21-06-2016 2/2 This anticipatory bail petition is dismissed as withdrawn.
If the petitioner surrenders in the court below, i.e., learned Chief Judicial Magistrate, Udakishunganj, Supaul in Supaul P.S. case No. 189 of 2011, and pray for regular bail, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this court.
