The petitioner is languishing in custody since 26.07.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

It is alleged that the dacoity was committed in the house of the informant. The name of the petitioner sprang up on the confession of Baijnath Sahni and Rambalak Paswan. Statement has been made in para 7 of the petition that neither the petitioner was named in the FIR nor any incriminating article has been recovered from the petitioner nor the petitioner has been put on TIP. Though, the petitioner is

Patna High Court Cr.Misc. No.14241 of 2015 (02) dt.28-04-2015 2/2 accused in one other case of similar nature.

Considering the fact that petitioner has not been put on TIP and the investigation has concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in connection with Madhuban P.S. Case No. 205 of 2013.
