JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-11-2019 The petitioner apprehends his arrest in connection with Laukariya P. S. Case No. 02 of 2016 registered under Sections 323,341,354 and 448 of the Indian Penal Code. Allegation against the petitioner is that he entered into the house of the informant and outraged her modesty. The police has seized slipper and jacket of the petitioner, who, while fleeing away, had left the same near the place of occurrence. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village politics. He further submits that petitioner has given undertaking that he will be cooperating with the investigation and will not tamper with the evidence. Learned counsel further submits that the police had given privilege of Section 41(a) of the Cr.P.C. to the petitioner and bonds submitted by the petitioner before the

After having heard learned counsel for the parties and taking into consideration the fact that petitioner has submitted a bond before the police, I am inclined to grant anticipatory bail to him.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. P.K.Sharma, J.M. 1st, Bagaha, West Champara in connection with Laukariya P.S.Case No. 02 of 2016; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
