2. In this case, the petitioner is seeking regular bail in connection with Pothiya P.S. Case No. 77 of 2024, registered for the offences punishable under Sections 64, 76, 308, 3(5) of the BNS and 67(A) of the I.T. Act and later on Section 4 and 6 of POCSO Act were added.

3. As per the FIR, co-accused Ritik Yadav trapped the minor daughter of the informant, and at the pretext of marriage, sexually exploited her and also took her obscene photographs. Thereafter, he along with other co-accused persons threatened her to make the photos viral and also extorted Rs. 8-10 lakhs from her.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.62958 of 2025(5) dt.05-01-2026 2/2 that the petitioner is innocent and has falsely been implicated in the present case. He has further submitted that main allegation of sexual exploitation is against co-accused Ritik Yadav and not against this petitioner. The allegation against the petitioner is that he assured the victim to facilitate her marriage with the main accused, Ritik Yadav. It has further been submitted that the petitioner is a person of clean antecedent and is in custody since 15.07.2025.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail by submitting that the petitioner has also complicity in the alleged occurrence.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-VI-cum-Special Judge, POCSO, Katihar in connection with Pothiya P.S. Case No. 77 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
