The petitioner is apprehending arrest in a case registered for the offences punishable under Section 135 of Electricity Act. The accusation is of consumption of electric energy unauthorizedly and the loss has been calculated to the tune of Rs.6,79,450/-.

The petitioner claims to have deposited Rs.2,75000 and Rs.69,589/- in two installments. The petitioner further undertakes to deposit Rs.75000/- within three months. The said deposit will be subject to the final assessment or compounding proceeding. Considering the present stand of the petitioner, let the

No.15674 of 2015 (2) dt.13-05-2015 2/2 above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Gaya in connection with Buniyadganj P.S. Case No. 35 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner shall be confirmed by the learned court below on being shown the receipt of the authorities of deposit of Rs.75000/- within the aforementioned period.
