JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 406,409/420 of the Indian Penal Code.

Prosecution case is that petitioner did not complete the work entrusted to him uder the Nal Jal Scheme even after getting its amount.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that just after lodging of the FIR, work has already been completed which would also be evident from letter dated 10.2.2022 (Annexure 3), of the Block Panchayati Raj Officer. Petitioner has got no criminal antecedent. Similarly situated co-accused has already been allowed bail by a coordinate bench of this Court vide order passed in Cr.Misc.No.

Considering the fact that the contract work has already been completed, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Rohtas at Sasaram in Kochas Police Station Case No. 134 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
