2. Learned counsel for the petitioners submits that the petitioners' case is squarely covered by the order passed by a coordinate Bench of this Court in C.W.J.C. No. 11255 of 2016 dated 22.08.2019. He further submits that the case of similarly situated teachers was allowed by the authority concerned (Annexure-P/4 to the rejoinder of the writ application). He

Patna High Court CWJC No.14176 of 2024(4) dt.07-04-2025 3/3 further submits that the petitioners are eligible to get the similar benefit as the respondent nos.5 and 6 have given to the similarly situated teachers by way of Memo No.5043 dated 13.10.2023 and Memo No.1792 dated 14.03.2024.

Considering the facts and circumstances of the case, the petitioners are directed to file a fresh representation, enclosing all the supporting documents, before the respondent no. 5 (The District Education Officer, Samastipur) within four weeks and the respondent no. 5 would pass a reasoned and speaking order in accordance with law within one month, after personally hearing the learned counsel for the petitioners, considering the fact that the case of similarly situated teachers was allowed by the authority concerned.

5. It is made clear that the respondent no. 5 shall be personally responsible for non-compliance of this order within the stipulated period.
