The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379, 34 of the Indian Penal Code and 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that on protest being made by the informant for abusing while he was going towards the filed for natural call, he was assaulted and petitioner no.1 took away a golden chain worth of Rs.31,000/-.
It is submitted by learned counsel for the petitioners that the accusation is general and omnibus and the informant has
Patna High Court Cr.Misc. No.14663 of 2015 (2) dt.10-04-2015 2/2 retracted from initial version. For the occurrence of 12.07.2014, the F.I.R. was registered on 13.07.2014 but it reached to the court of learned Judicial Magistrate on 17.07.2014 which suggests antedating of F.I.R.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Madhubani in connection with SC/ST P.S. Case No.38 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
