The petitioner apprehends her arrest in connection with Warisnagar P.S. Case No.294 of 2016 registered under Sections 304(B)/34 of the Indian Penal Code.
The accusation is of killing the deceased, the daughter of the informant, by her husband and mother-in-law (petitioner) for non fulfillment of the dowry demand by pressing her neck. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the mother of Ravi Kumar Mahto, who had performed the marriage with the deceased, the daughter of the informant, due to love affair and the deceased, the daughter of the informant, used to live at the outhouse of her
Patna High Court Cr.Misc. No.27548 of 2017 (3) dt.21-09-2017 2/2 Maika, situated near the house of the petitioner, and she died there. Moreover, Ravi Kumar Mahto, the husband of the deceased, the daughter of the informant, is already in custody. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Warisnagar P.S. Case No.294 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
