The petitioner has prayed for bail in a case registered for the offence punishable under sections 366 of the Indian Penal Code and later on Section 302 IPC was further added. Prosecution case relates to abduction of the daughter of the informant and thereafter, her dead body was recovered from Punpun river then the FIR was lodged on the basis of suspicion against the petitioner.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Victim girl went missing from her house since 23.08.2021 but FIR has been lodged on 26.08.2021. It appears that Save and except suspicion and self confessional statement, there is no other
Patna High Court CR. MISC. No.984 of 2022(6) dt.17-02-2023 2/2 cogent material on record to connect the petitioner with the alleged crime. There is no eye witness of the occurrence. During investigation, from CDR, it appears that deceased used to talk on several mobile numbers with several persons. Petitioner is languishing in judicial custody since 08.09.2021. The application for bail is opposed by learned APP for the State and submitted that as per postmortem report, deceased died due to throttling by applying pressure over neck. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daugnagar, Aurangabad in connection with Obra P.S. Case No. 201/2021.
