JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 342, 447,504,506 and other ancillary sections of the Indian Penal Code. Prosecution case is that this petitioner and her husband along with 50 to 60 unknown persons obstructed and created chaos in the camp where relief materials were distributed to the flood affected persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. petitioner is ward member of the affected ward and she was merely raising the difficulties of the affected persons of her ward which infuriated officials leading to lodging of this false case. Petitioner is a lady and claims clean antecedent. Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.61964 of 2022(2) dt.16-03-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Lauriya Police Station Case No. 244 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
