The petitioner has preferred this application for grant of regular bail in a case registered under Section 392 of the Indian Penal Code.
As per the prosecution case, two boys riding on a motorcycle came and they looted the informant's purse containing Rs. 65,000/-, passbook of Post Office, Central Bank, PNB and SBI ATM card, two mobile phones, PAN Card and Aadhar Card.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.64908 of 2022(2) dt.13-03-2023 2/2 the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and he is not named in the FIR. The petitioner has got four others criminal cases out of which, petitioner is on bail in three cases, as stated in para 3 of the bail petition. No T.I. Parade has been conducted by the prosecution. The petitioner is in custody since 28.03.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 130 of 2022.
The application stands allowed.
