JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Alamganj P. S. Case No. 117 of 2019, disclosing offences under Sections 307 and 324 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R. there is allegation against the petitioner that he fired on the informant, causing injury on his leg. Submission of the learned counsel for the petitioner is that there are Saraswati Pooja procession, some occurrence took place getting advantage of the same, he has falsely been implicated in this case. No injury is available on the record. The Case diary was also called for.

Heard learned A.P.P. also, who has submitted that the impugned order and paragraphs of the case also shows that the treatment was done at MCH, but there is no injury report is

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Patna City, Patna, in connection with Alamganj P. S. Case No. 117 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
