ANJANA MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Raxaul P.S. Case No.22 of 2015 for allegedly having committed the offence under Sections 342, 323, 494 and 308 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there was some altercation, there shall be no recurrence of any untoward act in future and he shall maintain and provide the informant with all necessary amenities as she is the first wife of the petitioner. Learned counsel for the petitioner further submits that if need be, he is also willing to pay her some

Considering the aforementioned offer made by the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, in connection with Raxaul P.S. Case No.22 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is, however, made clear that if at all there is any untoward incident, including any physical assault being inflicted on the informant, it shall be open to her to move this Court for modification/cancellation of the present order. (Anjana Mishra, J) PNM U T
