ANJANA MISHRA ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and the learned counsel appearing for the informant. No one appears for the State.

The petitioners are apprehending their arrest in connection with Manpur P.S. Case No.40 of 2017 for allegedly having committed the offences under Sections 323, 341, 324, 308/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of the petitioners that admittedly, all the accused persons are family members. Petitioner No.1 is the step-brother of the informant, Petitioner

Patna High Court Cr.Misc. No.27048 of 2017 (2) dt.06-07-2017 2/2 No.2 is the son and Petitioner No.3 is the wife of Petitioner No.1.

Considering the fact that the injuries purported to have been inflicted have been found to be simple in nature and that there is, admittedly, a land dispute between the family members, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Nalanda at Biharsharif, in connection with Manpur P.S. Case No.40 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
