2. The petitioner apprehends his arrest in connection with Complaint Case No. 1952 of 2019 offences punishable under Sections 406, 420, 467, 468, 504 and 506 of the Indian Penal Code.
3. The present application is a second anticipatory bail application is as earlier the anticipatory bail application had been withdrawn. However, it seems from orders dated 20.12.2024 and 04.08.2025 passed by this Court, it would be clear that the present application was entertained only
Patna High Court CR. MISC. No.68381 of 2024(4) dt.11-08-2025 2/3 on the ground that the petitioner had made a specific assertion in paragraph 11 of this petition that he was ready to pay Rs. 1 lakh which was deposited in the Sun Shine Global Agro to the complainant.

It has been submitted on behalf of the learned counsel for the petitioner that so far as the rest of the amount is concerned, the same was deposited in Sahara India of whom the petitioner was acting as an agent. It has been submitted that the petitioner is ready to pay Rs. 1 lakh in two installments within a period of two months.
5. Learned counsel appearing for the Opposite Party No. 2 although submits that this is not the entire amount in question but yet agrees to recieve the said amount for the purposes of bail only.

In such view of the matter, I am inclined to grant the privilege of Provisional Bail to the petitioner on the payment of first installment of Rs. 50,000/- within the period of six weeks from today. The learned Court concerned would accept the bail bonds only upon proof of payment of the said amount of Rs. 50,000/-. Further, the learned Court below would only confirm the Provisional Bail granted to the petitioner upon payment of the next installment of Rs. 50,000/- which would be made within a
Patna High Court CR. MISC. No.68381 of 2024(4) dt.11-08-2025 3/3 period of another month from the date of furnishing of the bail bonds. However, in case the petitioner fails to make the said payment within the stipulated period, the learned Court below shall vacate the Provisional Bail granted to the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be enlarged on Provisional Bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I, Bhagalpur in connection with Complaint Case No. 1952 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of the B.N.S.S., 2023.
7. The application stands disposed of with the above observation.
