JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kuchaikot P.S. Case No. 219 of 2019 for the offence under Sections 406/409/420/120(B) of the Indian Penal Code and Section 7 of the E.C. Act.

Allegation against the petitioner is that the petitioner was a PDS dealer and during search of his shop, certain irregularity was found.

Learned counsel for the petitioner submits that the petitioner is aged about 70 years. He further submits that the petitioner has got no criminal antecedent and he is in custody since 29.07.2019. He submits that at the best, the case against the petitioner is violation of the condition of PDS license.

No.58389 of 2019(2) dt.19-09-2019 2/2 Considering the fact that the petitioner is aged about 70 years and has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Gopalganj in connection with Kuchaikot P.S. Case No. 219 of 2019.
