JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 The petitioner seeks regular bail in connection with Rupauli P.S. Case No. 136 of 2016, registered for offences punishable under Sections 341, 323, 379, 376, 511/34 of the Indian Penal Code and Section 10/12 of POCSO Act. Allegation against the petitioner and other co-accused person is of attempting to commit rape on the minor girl of the informant.
It has been submitted on behalf of the petitioner that informant is in habbit of filing false cases against the petitioner as earlier also she has filed two cases against the petitioner and in both the cases, police after investigation did not find the case true, this fact has been stated on oath by learned counsel for the petitioner in para - 7 of this petition. Further some proceedings are
Patna High Court Cr.Misc. No.27188 of 2017 (2) dt.12-07-2017 2/3 also pending in the Court of SDJM between the parties. Petitioner has been in judicial custody since 18.02.2017. Heard learned A.P.P. also.
Having heard both sides, in view of the facts as stated above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Purnea, in connection with Rupauli P.S. Case No. 136 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the
Patna High Court Cr.Misc. No.27188 of 2017 (2) dt.12-07-2017 3/3 prosecution will be free to move for cancellation of his bail bonds.
