JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 The petitioner seeks regular bail in connection with Jamore P.S. Case No. 02/14, registered for offences punishable under Section 392, 395, 120B, 412 and 420 of Indian Penal Code. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name transpired in this case only on the basis of confessional statement of co-accused. Further no recovery has been made an uptil no Test Identification Parade has been conducted and has been in judicial custody since 23.01.2017.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, from perusal of the records, it appears that petitioner is an accused in as many as seven other cases and all those cases are of serious nature including the Arms
Patna High Court Cr.Misc. No.27151 of 2017 (2) dt.12-07-2017 2/2 Act, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly rejected. However, the trial court is directed to expedite the trial and try to conclude it within a period of six months. At the same time, S.P. Aurangabad, is also directed to ensure the production of witnesses in the Trial Court on the date fixed so that the trial can be concluded within the prescribed period.
Learned Trial Court is further directed to submit monthly report with regard to progress of trial and the office is directed to list the case under the heading "For Orders" after receipt of the report.
It is made clear that the above order must be complied strictly.
