The petitioner is in custody in connection with Bihariganj P.S. Case No. 110 of 2017 for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. From the FIR and the seizure list, it appears that about 2 1⁄2 liters of country made Mahua Chulai wine kept in the dickey of the motorcycle bearing registration No. BR 34K 4145 was recovered.

The petitioner is in custody since 1.4.2017. In para-3 of the application statement on affidavit has been made that the petitioner has no criminal history.

No.27180 of 2017 (2) dt.01-07-2017 2/2 In view of the facts and circumstances mentioned above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhimanu Kumar, Judicial Magistrate 1st Class, Udakishunganj, Madhepura or the successor Court in connection with Bihariganj P.S. Case No. 110 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
