JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 06.08.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner happens to be husband of the deceased who died within three years of her marriage.
There is allegation of illegal demand as well as torturing against the petitioner.
According to the prosecution case itself, deceased died in other than normal circumstance within four walls of the house of the petitioner.
Therefore, I am not inclined to grant privilege of bail to the petitioner and hence, his prayer for bail in connection with Bidupur P.S. Case no. 174/2014 stands rejected.
Patna High Court Cr.Misc. No.16914 of 2015 (3) dt.06-08-2015 However, Chief Judicial Magistrate, Vaishali at Hajipur/ concerned court is directed to commit the case of the petitioner to the court of sessions in accordance with law as early as possible and after commitment, the concerned Sessions court shall expedite the trial of the petitioner. shahid (Hemant Kumar Srivastava,J) U T
