The petitioner seeks regular bail in connection with Excise P.S. Case No. 220 of 2017, registered for the offence under Section 30 (a) (d) of Bihar Prohibition and Excise Act, 2016. The accusation is with regard to the excise official and Police force recovering 70 litres of illegal country made wine and 2000 Kg. Mahua.
Learned counsel for the petitioner submits that, in fact, the said illicit liquor etc. have not been recovered from possession of the petitioner. It is also submitted that the petitioner does not have any criminal antecedent and he is in jail custody since 9.5.2017.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.27189 of 2017 (2) dt.15-06-2017 2/2 case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount to the satisfaction of learned A.S.J.- II- cum- Special Judge, Excise, Rohtas (Sasaram) in connection with Excise Case No. 220 of 2017.
