JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2018 Pursuant to the deliberations made by this Court, the parties to the present case do not deny that the present case can be amicably settled.
In view of the instructions taken by the respondents as also the offer made by the petitioner which are not at a great distance, this Court feels that the interest of justice would be served in case the petitioner is directed to pay a sum of Rs. 4,00,000/- (Rupees four lakhs) lump sum for the purposes of liquidation of the loan amount.
Accordingly, the present writ petition is disposed of with a direction to the petitioner to deposit a sum of Rs. 4,00,000/- (Rupees four lakhs) within a period of 12 weeks' from today. It is needless to state that any amount paid by the
Patna High Court CWJC No.8562 of 2018 (4) dt.22-11-2018 2/2 petitioner after the demand notice was issued on 17.07.2017 as also any Fixed Deposit deposited by the petitioner, shall be deducted from the said sum of Rs. 4,00,000/- (Rupees four lakhs), if not already adjusted.
