JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-09-2019 The present writ petition has been filed seeking the following reliefs:- (i) For issuance of an appropriate writ in the nature of mandamus or any other appropriate writ / writs, order / order, direction/direction commanding the respondents to fix the pension of the petitioner in the Scale of Rs. 14010/- (G.P. 2400/-) and make payment of all consequential benefits i.e. arrears of differences of pension, Gratuity, Leave Encashment, Group Insurance amount (with 18% interest as per the Govt. notification).

(ii)For issuance of direction to the respondents to make payment of Arrears of differences of salary of Rs. 10,36,509/- (upto 2017-18) with 18% penal interest per annum and also to pay

Patna High Court CWJC No.18145 of 2019(2) dt.09-09-2019 2/2 the exemplary cost due to laches and harassing attitude of the respondents.

Having regarding to the nature of grievances raised by the petitioner, I deem it fit and proper to grant liberty to the petitioner to approach the Respondent No. 3 by filing appropriate claim petition within a period of four weeks from today whereupon the Respondent No. 3 would adjudicate upon the same and pass necessary order and in case, any amount is found outstanding and due for payment to the petitioner herein, the same shall be paid within a further period of four weeks, therefrom.

The writ petition stands disposed of on the aforesaid terms.
