The petitioner seeks bail in Bhawanipur (Balia O.P.) P.S. case No. 89 of 2016 under Section 302/34 of the Indian Penal Code.
The learned counsel for the petitioner submits that prayer of petitioner for bail was earlier rejected by this court vide order dated 19.04.2017 passed in Cr. Misc. No. 8467 of 2017 as prayer of similarly situated accused Bipin Singh and others was rejected by a coordinate Bench of this court vide order passed in Cr. Misc. No. 2930 of 2017 with a direction that petitioners of Cr. Misc. No. 2930 of 2017 may renew their prayer for bail after framing of charge. It is submitted that Bipin Singh and Babul Kumar Singh @ Babul Singh, petitioners of Cr. Misc. No. 2930 of
Patna High Court Cr.Misc. No.27137 of 2017 (2) dt.28-06-2017 2/2 2017, have already been enlarged on bail by a coordinate Bench of this court vide order dated 03.05.2017 passed in Cr. Misc. No. 21128 of 2017. The case of petitioner stands on same footing. Considering the fact that case of petitioner stands on same footing as that of Bipin Singh and Babul Kumar Singh @ Babul Singh, who have already been granted bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Purnea in S.T. No. 88 of 2017, arising out of Bhawanipur (Balia O.P.) P.S. Case No. 89 of 2016. (Prabhat Kumar Jha, J) BKS/- U T
