The petitioner seeks bail in Muffasil P.S. Case No. 462 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, this petitioner along with other accused persons having armed with lathi, danda, Farsa, Garasa, gun etc. assaulted the informant, her husband and others, as a result of which they sustained injury and they also damaged the vehicle. The accused persons snatched gold chain and tried to outrage the modesty of female of members of the family. It is submitted on behalf of the petitioner that no specific over act has been raised against this petitioner. The

Patna High Court CR. MISC. No.1798 of 2022(3) dt.28-04-2022 2/2 injuries has been found to be simple in nature by the doctor. The police after investigation submitted chargesheet under Section 354 IPC. Petitioner is in custody since 05.10.2021. Investigation is complete.

Counsel for the Informant however, vehemently opposed the prayer for bail and submitted that there is specific and direct allegation against this petitioner of throwing acid and also tried to outrage the modesty of female member. Considering the period of custody and nature injury, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 462 of 2020.
