2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
3. The petitioner is apprehending his arrest in connection with Ara Nawada P.S. Case No. 466 of 2023 dated 02.07.2023 registered for the offence punishable under Sections 363 and 366 of the I.P.C.
4. As per the prosecution case, the petitioner is alleged to have abducted the sister of the informant by enticing her on the pretext of marriage.

5. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. The petitioner and the girl appeared before this Court and the victim has stated before this Court that she married the petitioner in 'Mahthin Maai Temple', Bihiyan, on 03.07.2023 with her own free will and has been residing together as wife and husband and in support of her contention, two affidavits sown on 03.07.2023 by the victim and the petitioner before the Notary Public, Buxar, have been annexed as Annexure-2 series to the bail application. The petitioner has also supported the contention made on behalf of the victim. The victim is a major girl. Further, the victim was not forced to have illicit intercourse with another person. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.
6. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
7. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be

No.65495 of 2023(4) dt.05-12-2023 3/3 enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur, Ara, in connection with Ara Nawada P.S. Case No. 466 of 2023, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
8. The application stands allowed.
