2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2018, registered in connection with Kargahar (Barhari) P.S.Case No.159 of 2024.
3. As per allegation, in course of patrolling, the informant and other police personnel noticed some suspicious activity of the petitioner, who on seeing the police party, started fleeing away, but was overpowered. On search, five litres of mahua liquor kept in a plastic bag thrown by the petitioner was recovered.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.66094 of 2024(2) dt.24-09-2024 2/2 that the entire allegation is false and fabricated and nothing has been recovered from his conscious possession. He is in custody since 31.05.2024 for no fault of his.
5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.1, Rohtas at Sasaram in connection with Kargahar (Barhari) P.S.Case No.159 of 2024 subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
