Petitioner is in judicial custody in connection with Jogbani P.S. Case No.67 of 2021 lodged on 01.04.2021 instituted under Sections 25(1-b)a, 26/35 of the Arms Act.

Allegation against the petitioner is that when the police patrol party apprehended him, a country-made pistol, a mobile and a motorcycle without any registration number was recovered. Learned Senior counsel for the petitioner submits that the petitioner is victim of circumstance and has been apprehended merely on suspicion as also only because he has criminal antecedent, he has been implicated in this case. He further submits that he is in jail since 02.04.2020 (as stated in para-11 of the bail application). Taking into account the aforesaid facts including the fact that the charge sheet has already been submitted and he is in custody since 02.04.2021, let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.2052 of 2022(2) dt.27-04-2022 2/2 bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each in connection with Jogbani P.S. Case No.67 of 2021 to the satisfaction of learned A.C.J.M., VIth, Forbesganj, Araria , subject to following conditions:

(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reasons will entail cancellation of his bail by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every month for next six months to mark his presence; (iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to steps for cancellation of his bail bonds.

With the aforesaid observation the bail application is allowed.
