2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126(2), 115(2), 118(1), 109, 303 ( 2 ), 352, 351(3), and 3(5) of B.N.S. 3 . As per the prosecution case , informant namely , Subhanti devi alleged that on 20.06.2025 at about 8 PM when informant was preparing food, in the meantime , all the F.I.R. named accused persons including this petitioner started abusing informant and her father-in -law . Upon protest, accused persons pelted stones and also assaulted informant and her husband with iron rod. It is further alleged that this petitioner snatched

No.62996 of 2025(2) dt.10-09-2025 2/3 mangalsutra worth Rs. 35,000/- from neck of informant and other accused persons took away Rs. 17,000/- from box and other ornaments of worth Rs. 1 lakh . When nearby villagers assembled there , accused persons threatened with dire consequences and fled away from spot.

It is submitted on behalf of the petitioners that specific accusation of assault is against co-accused co-accused persons and this petitioner is only alleged to have snatched mangalsutra from neck of informant which is ornamental in nature to make the case grave . There is absolutely no allegation of any overt act against this petitioner. Petitioner is lady . 5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Motihari, District East Champaran in connection with Raghunathpur P.S. Case No. 168 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya
