Petitioner seeks bail in Sherghati P.S. Case No.39 of 2014 instituted under Section(s) 302/34 Indian Penal Code pending in the Court of the ADJ IV, Gaya.
Prayer of the petitioner for bail was earlier rejected by this Court by order dated 17.01.2017 passed in Cr. Misc. No.52601 of 2016.
This fresh bail application has been filed on the ground that the informant and three witnesses have already been examined and only official witnesses are left to be examined in the case.
Since the trial is at the advance stage, this Court is not inclined to enlarge the petitioner on bail.
Patna High Court Cr.Misc. No.27213 of 2017 (3) dt.12-07-2017 2/2 Prayer for bail is once again rejected.
The Trial Court is directed to expedite the trial and make efforts to conclude the same within a period of six months from the date of receipt of a copy of this order by giving short adjournments.
Liberty is given to the petitioner to renew his prayer for bail after six months if trial is not concluded and in that event, the Court below will give reasons as to why trial has not been concluded within the aforesaid time.
