2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 324, 307, 379, 34 of the Indian Penal Code.
3. As per the prosecution case, petitioners alongwith
Patna High Court CR. MISC. No.65408 of 2023(2) dt.18-10-2023 2/3 co-accused Praveen Kumar Singh, who are named in F.I.R., and 5-6 unknown persons, variously armed, entered the house of informant and co-accused Praveen Kumar Singh assaulted on the head of informant with butt of pistol and Ritesh Kumar Singh (petitioner no. 8) assaulted on the head of Shushant Kumar Singh by sharp cut weapon and thereafter, all the accused persons looted the ornaments and cash from the house of informant.
4. Considering the specific accusation of assault against Ritesh Kumar Singh (petitioner no. 8), his prayer for anticipatory bail is refused.
5. So far as prayer for anticipatory bail of other petitioners i.e. petitioner no. 1 to 7, as named above, is concerned, since there is general and omnibus allegation and no specific overt act has been alleged against them, in the event of their arrest/surrender within a period of six weeks from today, he is directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th A.C.J.M., Darbhanga in connection with G.R. No. 583 of 2023, arising out of Baheri P.S. Case No. 48 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
