ANJANA MISHRA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bibhutipur P.S. Case No.126 of 2015 for allegedly having committed the offence under Sections 341, 307, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier, injury report had been called for with regard to the present case. It appears from the injury report that the injury purported to have been inflicted on Pawan Kumar Mahto was, in fact, simple in nature.

In view of the aforementioned facts and circumstances, let the petitioner, above named, in the event of

Patna High Court Cr.Misc. No.12882 of 2016 (4) dt.26-07-2016 2/2 his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera, District-Samastipur, in connection with Bibhutipur P.S. Case No.126 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
