JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Falka P.S. Case No.275 of 2015 for the offences instituted under Sections 147, 341, 323, 324, 447, 307 and 506 of the Indian Penal Code.

The prosecution case, in brief, is that the informant Sahinoor Khatoon lodged this case alleging vide her written statement that on 21.11.2015 at around 8 O'clock when the driver ploughing his land by tractor in his land at where all the petitioners along with co-accused came there and assaulted the

Patna High Court Cr.Misc. No.15567 of 2016 (2) dt.03-05-2016 2/2 driver of his tractor for which when informant's husband made objection then all the accused persons have brutally assaulted her husband Md. Saqur with iron rods.

It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and counter case between the parties. Subsequently, later on, a compromise has been filed in the court below, which is Annexure4 to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar, in connection with Falka P.S. Case No.275 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) N.H./- U T
