JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner and learned counsel for the APP.

The informant claims that her husband had gone to the house of the petitioner to attend a party but in the next morning she learnt that the dead body of her husband was lying near the Gandhi Chowk and having received the information, she went there and found the dead body of her husband lying by the side of the road. The informant expressed her suspicion against the petitioner and others. The postmortem report of the deceased reveals that some injuries were found on forehead and neck of the deceased and cause of death of the deceased is said to be coma due to said head injury caused by hard and blunt substance. Patna High Court Cr.Misc. No.13136 of 2016 (2) dt.01-04-2016 deceased was a drunkard and as a matter of fact, he met with an accident and got some injuries as a result whereof he died. Admittedly, none has seen the actual killing of the deceased and except the suspicion, there appears to be nothing against the petitioner who is languishing in jail custody since 10.01.2016.

Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in connection with Bidupur P.S.Case No.09 of 2016.
