JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 380, 411 of the Indian Penal Code.

Petitioner is said to have been caught by the police when he had entered to commit theft in the house of the informant and mobile sets and some cash are said to have been recovered from possession of the petitioner.

Submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and is languishing in jail custody since 10.01.2016. Moreover, no stolen article was recovered from possession of the petitioner. Considering the aforesaid facts and circumstances as

No.14977 of 2016 (3) dt.19-04-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 18 of 2016.
