JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged against the petitioner that on order of co-accused Shankar Rai, he fired upon the informant, as a result of which, the informant sustained firearm injury on left thigh.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is land dispute
Patna High Court CR. MISC. No.62574 of 2022(3) dt.27-03-2023 2/2 between the parties and the doctor opined the injury of the informant to be simple in nature caused by gunshot. The petitioner is languishing in custody since 27.07.2022.
Learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner and submitted that due to gunshot injury caused by the petitioner, the informant received injury. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Siwan in connection with Maharajganj P.S. Case No. 253 of 2021.
