Earlier the prayer for bail of the petitioner was rejected, vide order dated 26.11.2018 passed in Cr. Misc. No.51068 of 2018 though in the FIR, hands was suspected but later on during the investigation it has come that he had fired at the deceased causing his death. Apart from the fact he is accused in 16 other cases.

Learned counsel for the petitioner has fairly submitted that out of 16 witnesses, 11 witnesses have been examined, 03 witnesses have already died and 01 witness is residing at USA so this matter remained pending for the examination of the Doctor and he is in custody for more than four years. Heard learned APP.

No.58481 of 2019(2) dt.18-09-2019 2/2 In view of the facts as stated above, especially the fact that the petitioner is in custody for four years, learned trial court is directed to expedite the trial and conclude it within a period of six months from the date of receipt of the order. At the same time the District Magistrate, West Champaran at Bettiah as well as the Civil Surgeon, West Champaran at Bettiah are directed to produce the Doctor in the court on the date fixed; otherwise this Court will have no option to proceed against them.

Let a copy of this order be communicated to the District Magistrate, West Champaran at Bettiah as well as the Civil Surgeon, West Champaran at Bettiah also. (Vinod Kumar Sinha, J) chn/- U T
