12-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Petitioner has renewed her prayer which was earlier rejected vide Cr. Misc. No.48456/2015 as well as Cr. Misc. No.23868/2016, after considering the merit of the case in consonance with the plea of the petitioner.
Now, a prayer has been made on the ground that as informant is taking dilly delaying tactics in getting instant trial disposed of at an earliest whereupon, has filed Cr. Misc. No.45985/2017 which is still running under removal of defect against the order dated 25.05.2017 so, considering the period of detention inconsonance with the age of the petitioner, she be allowed privilege of bail.
The learned Additional Public Prosecutor opposed the prayer.
Patna High Court Cr.Misc. No.30479 of 2017 (3) dt.12-07-2017 Considering the rival submissions made on behalf of respective parties, prayer for bail is rejected. However, it is made clear that if the trial is not concluded within a year then in that event, petitioner will be at liberty to renew her prayer for bail. (Aditya Kumar Trivedi, J.)
