Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Sonpur P.S. Case No. 252 of 2022 lodged under Sections 341, 323, 498A, 504, 379, 506/ 34 of the I.P.C. read with Sections 3 & 4 of the Dowry Prohibition Act.
As per the prosecution case, the main allegation of Section 498A is there against the husband and other family members. The allegation of domestic violence is also there in the F.I.R. The apprehension of the informant is also there that her husband is involved with a lady Puja Singh who is working in the office to whom he used to chat whole night. Allegation is also there to demand divorce.
Patna High Court CR. MISC. No. 62841 of 2022(2) dt.25-02-2023 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that he has tried his level best to maintain the good relation with his wife till date of his custody, he used to send money in the account of his wife but only after custody he stopped sending money in her account. All the allegations in the F.I.R. is based on suspicion. Counsel submits that petitioner's antecedent is clean and he is in custody since 12.08.2022. Learned counsel for the State opposes the prayer for bail and submits that mediation is required in the present case. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Saran in connection with Sonpur P.S. Case No. 252 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
It is directed that both the parties shall sit in mediation and try to resolve the dispute under the supervision of the Court. With this observation, the bail application stands allowed.
